Terms of Service for Gaia by Illuminum

Welcome, and thank you for choosing Illuminum’s services!

1. Definitions

The words of which the initial letter is capitalized have meanings as defined in this section. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

  • Company: (also referred to as “Illuminum”, "the Company", "we", "us" or "our") refers to Illuminum AB, a limited liability company existing under Swedish law, located at Västra Ågatan 22, 753 09 Uppsala.

  • Device: Any device that can access the Service such as a computer, a mobile phone, or a digital tablet.

  • Module: A distinct, self-contained component of the Service, designed to perform specific functions independently or in conjunction with other modules.

  • Observation: Any type of third-party data about species provided to You based on information gathered from external sources.

  • Observer: A human or instrument that has documented an Observation. The identity and expertise of the Observer are unknown to Us.

  • Service: (also referred to as "gaia.eco") refers to Illuminum's web-based “as-a-service” application, named “Gaia by Illuminum."

  • User Agreement: Refers to these Terms of Service, the Illuminum Data Privacy Policy, and Your registration information.

  • User Session: The period during which a user accesses and interacts with the Service, beginning at login and ending at logout or inactivity timeout.

2. Acceptance of Terms

These Terms of Service ("Terms") apply to the use of the Service provided by Illuminum AB. By accessing or using the Service, You agree to be bound by these Terms.

Illuminum’s Data Privacy Policy forms an integral part of this User Agreement. By using the Service, You agree to accept the Terms at all times.

3. The Service

3.1 The Purpose of Illuminum

Illuminum develops tools and services to empower the work of professionals and enhance learning. Our goals include:

  • Educating users about natural ecosystems and their inhabitants.

  • Accelerating nature conservation and the restoration of natural habitats.

  • Mitigating the effects of climate change on agriculture and forests.

  • Simplifying data-driven foraging within safe reproduction limits.

3.2 Gaia by Illuminum

Gaia by Illuminum is a web-based service that gathers and visualizes biodiversity data from across the internet, presenting it in an interactive map.

3.3 Changes to the Service

Illuminum reserves the right to update, change, or modify the Service without prior notice. If future changes make the Service unsuitable to You, You agree to discontinue use and cancel Your subscription.

4. Your Illuminum Account

To access our Service, You must create and validate an Illuminum Account.

  • Eligibility: You must be at least 16 years old.

  • Responsibility: You may not share Your login credentials. The account is non-transferrable.

  • Data: Any Personal Data provided is subject to our Data Privacy Policy. Deleting your account will remove your Personal Data, subject to the retention rules in section 5.3.

5. Grant of License

5.1 User License

Illuminum grants You a non-exclusive, non-transferable license to use the Service subject to your Service Plan and the User Agreement.

5.2 Service Availability

While we strive for 24/7 uptime, availability may be affected by maintenance or network disruptions. Illuminum does not guarantee uninterrupted access.

5.3 Misuse

Illuminum strictly prohibits the use of its Service for illegal or unethical activities, including:

  • Poaching or illegal wildlife trade.

  • Illicit biodiversity offsetting.

  • Over-exploitation of species or habitats.

Note: Suspected misuse may lead to an immediate account block and the sharing of data with law enforcement or conservation NGOs.

6. Third-Party Features

  • Integrated Services: Certain parts of the Service (like payments or secure login) use third-party providers. You agree to comply with their respective terms.

  • External Links: We are not responsible for the content or privacy practices of third-party websites linked within our Service.

7. Intellectual Property

7.1 Illuminum IP

All software, designs, and trademarks are owned by Illuminum or its suppliers. Unauthorized copying, reverse engineering, or distribution is strictly prohibited.

7.2 Observations

Observations provided by third parties are typically licensed under Creative Commons (CC0 1.0, CC4.0 BY, or CC4.0 BY-NC). You are responsible for complying with the specific license terms of individual Observations (e.g., proper attribution).

8. Data Collection

We collect data regarding your search activities and interface interactions to improve user experience and ensure security.

  • Personal Data: We do not sell your personal data.

  • Other Data: Aggregated, anonymous data may be shared with third parties for market insights.

9. Billing

9.1 Service Plans

  • Free Plan: Includes 2 cost-free searches with the "Forager" module per calendar week.

  • Day/Week Pass: Non-refundable; expires after 24 or 168 hours respectively.

  • Pro Subscription: Renews automatically. Refunds are available if cancelled within 15 days of purchase or renewal.

Failure to pay may lead to suspended access and interest charges.

10. Termination and Suspension

You may stop using the Service at any time by deleting your account. Illuminum reserves the right to terminate access immediately if You breach these Terms or if required by law.

11. Liability and Warranties

11.1 Limitation of Liability

ILLUMINUM'S TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID FOR THE SERVICE. We are not liable for incidental or consequential damages, including loss of profits or data.

11.2 No Warranties

THE SERVICE IS PROVIDED "AS IS." We disclaim all warranties, including merchantability and fitness for a particular purpose. We do not guarantee the accuracy of third-party data.

12. Miscellaneous

  • Governing Law: These Terms are governed by the laws of Sweden.

  • Severability: If any part of these Terms is found unenforceable, the remaining parts remain in effect.

  • Language: The English version of this agreement prevails over any translations.
